Agreement Overview

These Terms and Conditions ("Terms") govern the relationship between Lumina Weddings ("we," "our," or "us") and the client ("you" or "your") who engages our wedding photography and videography services. By booking our services, signing a service agreement, or making a payment, you agree to be bound by these Terms.

Please read these Terms carefully before engaging our services. If you do not agree with any part of these Terms, we respectfully request that you do not proceed with booking our services.

Important: These Terms supplement and are incorporated into the individual Service Agreement signed at the time of booking. In the event of any conflict, the Service Agreement shall take precedence.

Services Provided

Lumina Weddings provides professional wedding photography and videography services, which may include (but are not limited to):

  • Wedding Day Coverage: Full-day photographic and/or video documentation of your wedding celebration, as specified in your Service Agreement.
  • Engagement Sessions: Pre-wedding photo sessions at locations of mutual agreement.
  • Pre-Wedding Shoots: Dedicated photo sessions, potentially at destination locations.
  • Album Design: Custom-designed, professionally printed photo albums.
  • Video Editing: Cinematic highlight films, full-length wedding films, and teaser reels.
  • Drone/Aerial Coverage: Aerial photography and videography (subject to local regulations and weather conditions).

Specific services, hours of coverage, number of photographers/videographers, and deliverables are detailed in your individual Service Agreement.

Booking & Payment

3.1 Booking Confirmation

A booking is confirmed only upon:

  1. Signing of the Service Agreement
  2. Payment of the non-refundable retainer (typically 30% of the total package price)

Verbal or email inquiries do not constitute a confirmed booking. We operate on a first-come, first-served basis, and dates are held only after receipt of the retainer.

3.2 Payment Schedule

3.3 Payment Methods

We accept payments via bank transfer, credit card (Visa, MasterCard), UPI, Razorpay, and Stripe. All payments must be made in INR unless otherwise agreed in writing.

3.4 Late Payments

Failure to make payments by the scheduled due dates may result in the cancellation of your booking. A late fee of 5% per month may be applied to overdue balances.

Retainer Policy: The initial retainer fee is non-refundable under all circumstances. It serves as a reservation deposit to secure your wedding date and compensate for the time we reserve exclusively for your event.

Cancellation Policy

4.1 Client Cancellation

60–119 days before event 25% of total payments made (minus retainer)
Less than 60 days before event No refund

4.2 Rescheduling

If you need to reschedule your wedding date, please notify us as soon as possible. We will do our best to accommodate your new date subject to availability. A rescheduling fee of ₹15,000 may apply, and if the new date falls outside our availability within 12 months of the original date, cancellation terms (Section 4.1) will apply.

4.3 Studio Cancellation

In the extremely unlikely event that we are unable to provide our services due to unforeseen circumstances (illness, equipment failure, etc.), we will:

  • Make every effort to arrange a replacement photographer/videographer of similar skill and style
  • Provide a full refund of all payments made if no suitable replacement can be found
  • We are not liable for any additional costs incurred by the client in securing alternative services

Client Responsibilities

To ensure the best possible results, we ask that you:

  • Provide a Timeline: Share a detailed wedding day schedule at least 14 days before the event, including all key moments (baraat, ceremony, pheras, speeches, first dance, cake cutting, etc.).
  • Shot List: If you have specific photo requests or must-have family groupings, provide a list at least 14 days in advance. While we cannot guarantee every shot on the list, we will make our best effort.
  • Meals & Breaks: Provide a meal for each photographer/videographer during the reception/ceremony events. This ensures our team can work efficiently throughout the day without interruption.
  • Safe Working Environment: Ensure our team has safe and reasonable access to all areas where photography/videography is required.
  • Vendor Coordination: Inform us of any other photographers or videographers who will be present at your event. We reserve the right to decline working alongside unprofessional or disruptive vendors.

Delivery Timeline

We take pride in delivering high-quality, carefully edited media within the following timeframes:

  • Photo Preview (30–50 images): Within 2 weeks of the wedding date
  • Full Photo Gallery: Within 6–8 weeks of the wedding date
  • Video Teaser/Highlight Reel: Within 4–6 weeks of the wedding date
  • Full Wedding Film: Within 10–12 weeks of the wedding date
  • Custom Photo Album: Within 4–6 weeks of album design approval

Peak Season Note: During peak wedding season (November through February), delivery times may be extended by 2–4 weeks. We will notify you in advance if your delivery timeline will be affected.

Final media is delivered via a secure online gallery with download links. The gallery remains active for a minimum of 12 months, after which files may be archived. Clients are responsible for downloading and backing up their media.

Usage Rights & Copyright

7.1 Copyright Ownership

Lumina Weddings retains the copyright to all photographs and videos created during our services. This is standard industry practice and in accordance with the Indian Copyright Act, 1957.

7.2 Client Usage Rights

Upon full payment, you receive a perpetual, personal, non-exclusive, non-transferable license to:

  • Print and reproduce images for personal use
  • Share images on personal social media accounts (with credit to Lumina Weddings appreciated but not required)
  • Create personal photo books and prints

7.3 Restrictions

You may not:

  • Sell, license, or distribute the images for commercial purposes
  • Submit the images to competitions, stock photo sites, or publications without our written consent
  • Edit, alter, filter, or apply presets to our professionally edited images
  • Remove our watermark (if applied) or claim authorship of the images

7.4 Studio Usage Rights

Unless otherwise agreed in writing, Lumina Weddings retains the right to use wedding photographs and videos for portfolio display, marketing, advertising, social media, industry competitions, and editorial publications.

Privacy Request: If you prefer your images not be used publicly, you may request a non-disclosure addendum to your Service Agreement. A fee may apply to compensate for the reduced marketing value.

Limitation of Liability

Lumina Weddings shall not be liable for:

  • Loss or Damage of Images: In the event of camera malfunction, data corruption, or loss of images due to technical failure, our liability shall be limited to a pro-rata refund of the affected portion of the service. We maintain multiple redundant backup systems to minimize this risk.
  • Uncontrollable Conditions: Poor image quality resulting from weather conditions, inadequate lighting at the venue, or other environmental factors beyond our control.
  • Third-Party Actions: Any delays or disruptions caused by venue staff, wedding coordinators, other vendors, or guests.
  • Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages arising from our services.

Our total liability under any circumstances shall not exceed the total amount paid by the client for our services.

Force Majeure

Neither party shall be held liable for failure to perform their obligations under these Terms if such failure results from events beyond their reasonable control, including but not limited to:

  • Natural disasters (cyclones, earthquakes, floods, etc.)
  • Pandemics, epidemics, or public health emergencies
  • Government restrictions, lockdowns, or travel bans
  • War, terrorism, civil unrest, or riots
  • Unexpected illness or injury of key personnel
  • Equipment failure not caused by negligence

In the event of a force majeure situation, we will make every reasonable effort to reschedule the event or provide alternative arrangements. If rescheduling is not possible, a partial refund may be offered on a case-by-case basis.

Dispute Resolution

In the event of a dispute arising from these Terms or our services:

  1. Direct Negotiation: Both parties agree to first attempt to resolve the dispute through good-faith direct communication within 30 days of the dispute arising.
  2. Mediation: If direct negotiation fails, both parties agree to participate in mediation with a mutually agreed-upon mediator before pursuing any legal action.
  3. Arbitration: If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Good Faith: We are committed to client satisfaction and will always strive to resolve any concerns fairly and promptly. We value our relationships with clients and approach every dispute with the intention of reaching an amicable resolution.

Model Release

By engaging our services, you grant Lumina Weddings a non-exclusive, perpetual, worldwide license to use any and all images and video footage of you, your spouse, and your wedding party for:

  • Portfolio display (website, printed portfolios, studio displays)
  • Marketing and advertising materials
  • Social media posts and stories
  • Industry competitions and awards submissions
  • Editorial features in wedding magazines and blogs
  • Business development and promotional purposes

You may opt out of this model release by signing a Non-Disclosure Addendum and agreeing to the associated fee. This addendum must be requested and signed before your wedding date.

Modifications to Terms

Lumina Weddings reserves the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. The Terms in effect at the time of booking (as reflected in your signed Service Agreement) shall govern your engagement with us.

Changes to these Terms do not retroactively affect existing Service Agreements unless both parties agree in writing to the modifications.

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India, and specifically under the jurisdiction of the state of Maharashtra, without regard to conflict of law provisions.

Any legal proceedings arising from these Terms shall be filed in the appropriate courts located in Mumbai, Maharashtra. Both parties consent to the jurisdiction of these courts.
